An Ordinance to amend Article II and Article III of the Hayes Township Zoning Ordinance to revised dwelling related definitions and address short term rentals in general provisions.
The Township of Hayes Ordains:
Section 1. Amendment of Section 2.02
Article II of the Hayes Township Zoning Ordinance, Section 2.02 is hereby amended to amend the following definitions, each in their respective entirety:
Dwelling Unit: A single unit building, or portion thereof, providing complete independent living facilities for one (1) family for residential purposes, including permanent provisions for living, sleeping, heating, cooking, and sanitation. In no case shall a travel trailer, truck, bus, motor home, tent or other such portable structures be considered a dwelling unit.
Dwelling, Single-Family: A building or portion thereof, containing one (1) dwelling unit that is occupied by only one (1) family.
Dwelling, Two-Family: A building, or portion thereof, containing two (2) dwelling units that are occupied by two (2) families living independently of each other.
Dwelling, Multiple-Family: A building, or portion thereof, containing three (3) or more dwelling units that are occupied by three (3) or more families living independently of each other.
Section 2. Amendment of Article III, to add Section 3.26
Article III General Provisions of the Hayes Township Zoning Ordinance is hereby amended, to add Section 3.26 Short Term Rentals to read in its entirety as follows:
Section 3.26 Short Term Rentals
Short term rentals are permitted in all zoning districts as regulated by the Hayes Township Short Term Rental Ordinance.
Section 3. Severability.
If any section, clause, or provision of this Ordinance be declared unconstitutional or otherwise invalid by a court of competent jurisdiction, said declaration shall not affect the remainder of the Ordinance. The Township Board hereby declares that it would have passed each part, section, subsection, phrase, sentence, and clause irrespective of the fact that any one or more parts, sections, subsections, phrases, sentences, or clauses be declared invalid.
Section 4. Conflicts.
If any provision of the Hayes Township Zoning Ordinance conflicts with this Zoning Ordinance Amendment, then the provisions of this Zoning Ordinance Amendment shall control.

Section 4. Effective Date.
This Ordinance shall become effective eight (8) days after being published in a newspaper of general circulation within the Township.
